1) Introduction

These Terms govern your access to and use of Spoken Past (the “Site”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Plain-language note: The Site publishes educational content about the ancient world. Nothing on the Site is academic, legal, financial, or professional advice.

2) Eligibility

The Site is intended for individuals aged 16+.

3) Intellectual Property

Unless stated otherwise, all text, images, graphics, layout, and code on the Site are owned by or licensed to Spoken Past and are protected by copyright and other laws.

  • Permitted: View pages on your device; link to our pages (with proper attribution); quote short excerpts with clear citation and link back.
  • Prohibited without prior written permission: Republishing articles in full; systematic copying; bulk scraping; training models on our content; commercial use; creating derivative databases.
  • Images: Some images are used under license or specific rights; do not reuse unless we explicitly grant rights or the rights holder permits it.

4) Donations via Stripe

Donations are processed by Stripe using the currency EUR. We receive your contribution amount, currency, status, and the email used for the receipt. Card data is handled by Stripe and never touches our servers.

  • Receipts: Stripe emails a receipt. Keep it for your records.
  • Refunds: Donations are voluntary and ordinarily non-refundable. If there is an error (e.g., duplicate transaction), contact us promptly and we’ll review in good faith and as required by law.
  • No charitable tax status: Unless we explicitly say otherwise, donations are not tax-deductible.

Your use of Stripe is subject to Stripe’s own terms and privacy policy.

5) Acceptable Use

  • No unlawful activity, security probing, or service disruption.
  • No automated scraping, bulk harvesting, or rate-limit evasion.
  • No misrepresentation (e.g., posing as us) or use that infringes others’ rights.
  • No uploading or linking to malicious code or harmful content.

6) Content & Accuracy

We aim for clear, sourced writing. However, the Site is provided for educational purposes “as is” without warranties of accuracy, completeness, or fitness for a particular purpose. Historical interpretations can change; sources may be updated; errors can occur. You are responsible for how you use the information.

7) Links & Third-Party Services

The Site may link to third-party sites or embed third-party services (e.g., Stripe for donations, analytics providers). We are not responsible for third-party content, policies, or practices. Use them at your own risk and review their terms.

9) Disclaimers

To the maximum extent permitted by law, the Site and content are provided “as is” and “as available”. We disclaim all warranties, express or implied, including non-infringement, merchantability, and fitness for a particular purpose.

10) Limitation of Liability

To the maximum extent permitted by law, Spoken Past and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages; loss of profits, data, or goodwill; or service interruptions arising from or related to your use of the Site.

Where liability cannot be excluded under applicable Australian consumer law, our liability is limited to the lesser of: (a) the amount you paid to us (if any) in the 12 months before the claim; or (b) AUD 100.

11) Indemnity

You agree to indemnify and hold us harmless from claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Site or any violation of these Terms, to the extent permitted by law.

12) Changes to the Site or Terms

We may update the Site and these Terms from time to time. We will update the effective date above and may post a notice if changes are material. Continued use after changes means you accept the updated Terms.

13) Termination

We may suspend or terminate access to the Site at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful.

14) Governing Law

These Terms are governed by the laws of Australia. The courts of Australia will have jurisdiction, without prejudice to any mandatory protections under consumer law that apply to you based on your place of residence.
